Court Rejects Indictment against Ex-Special Prosecutor Dusan K.

Bratislava, 27 May (TASR) - A judge of the Specialised Criminal Court (STS) has rejected an indictment filed on 20 April 2021 against former head of the now-defunct Special Prosecutor's Office, Dusan K. [name abbreviated due to legal reasons], and returned the case to the prosecutor after identifying serious procedural errors involving violations of the defendant's right to defence and to a fair trial. According to information confirmed for TASR by STS spokesperson Iveta Pulman Erdelyiova, the prosecutor failed to submit complete case files, including all evidence gathered during pre-trial proceedings, and the indictment didn't meet the requirements set out in the Criminal Procedure Code. The case was first reported by the Aktuality.sk news website. The indictment against Dusan K. concerned the crimes of setting up, organising and supporting a criminal group, accepting bribes, misuse of power by a public official, and the misdemeanour of endangering classified and restricted information. Justice Minister Boris Susko (Smer-SD) filed an extraordinary appeal in summer 2024 in the case of then finally convicted former special prosecutor Dusan K. He also suspended the prison sentence pending a ruling by the Supreme Court on the appeal. On 11 December 2025, the Supreme Court ruled on the justice minister's appeal in the case of Dusan K. It overturned the previously final 2022 Supreme Court ruling as well as the 2021 STS verdict, and ordered STS to reconsider the case. In May 2022, the Supreme Court sentenced Dusan K. to eight years in prison for accepting bribes and leaking information from case files. It also imposed a fine of €100,000. STS had originally sentenced him to 14 years in prison in September 2021. mf/df
