Susko: We'll Submit New Civil Code for Consideration at Next Cabinet Meeting

Bratislava, 4 May (TASR) - A new Civil Code has been approved by the Government's Legislative Council and also passed without comment by the Economic and Social Council, Justice Minister Boris Susko (Smer-SD) stated following the Economic Council meeting, adding that the Justice Ministry will submit it to the government for deliberation on Wednesday (6 May). According to Susko, the new Civil Code will have a significant and positive impact on the business environment. "On the one hand, it will strengthen the autonomy of an individual's free will to structure their relationships in a way that suits them, and the Civil Code will only apply in a subsidiary manner here," said Susko, noting that unless the parties agree otherwise, the Civil Code will apply, but in most cases, the parties will be able to structure their legal relationships as they see fit. The business sector stands to benefit from the overarching provisions governing legal entities that have been enshrined in the Civil Code. Commercial companies will remain under the Commercial Code, just as they are now, said Susko. According to him, contractual relationships are also being unified in the Code. The section on obligations in the Commercial Code is being repealed and moved entirely to the Civil Code. "As a result, we'll no longer have two sales contracts or two contracts for work - one under the Civil Code and the other under the Commercial Code; this legal framework will be unified into a single piece of legislation," noted the minister. National Union of Employers head Miroslav Kiralvarga has urged MPs not to make any changes to this code if they were considering doing so. "This is a major legislative change that affects all of society, and any amendments to the Civil Code without very detailed analysis could undermine what has been painstakingly prepared over several years," he stated, stressing that the new Civil Code is an example of how legislation should be drafted. am/df
