Sipos and Kolikova: Use of Paragraph 363 Needs to be Restricted

Bratislava, November 29 (TASR) - The paragraph 363 is being employed inappropriately often and it has turned out that Prosecutor-General Maros Zilinka is covering the backs of former prime minister Robert Fico (Smer-SD) and Robert Kalinak, whose charges in the Twilight case he has withdrawn, OLaNO caucus chair Michal Sipos declared on Tuesday. "I'm very saddened by this, but we can't stop fighting for the cleansing of the state. This is an everyday fight. I cheer for all investigators, law enforcement bodies, in their fight and hope they don't give up, so that the justice is served to all thieves and protectors of thieves," he said. This view was echoed by ex-justice minister Maria Kolikova (SaS). "I don't welcome today's decision by the Prosecutor-General because I'm of the opinion that the indictment of MP Fico and ex-interior minister Kalinak should have been allowed to make it to the court. At the time when the investigation was about to be concluded, withdrawing the charges is really inappropriate," said Kolikova. She underlined that the case should have been heard by an independent court and it was up to a judge to decide whether or not Fico and Kalinak were guilty. Kolikova believes that the use of the Paragraph 363 must be restricted in the future and give room for criminal cases to make it to courts instead. Non-parliamentary Voice-SD respects the decision of the Prosecutor-General. "It's not our place as politicians to comment on decisions of the Prosecutor-General," said Voice-SD leader Peter Pellegrini. Fico and Kalinak were charged under the National Crime Agency's Operation 'Twilight' with setting up, masterminding and supporting a criminal group while in office, misusing their powers and disclosing someone else's confidential tax information.
